Was the JUUL Design Copied? CBD Company Sues JUUL

CBD company, Swissx Labs, is suing popular electronic cigarette brand, JUUL Labs, for infringing its copyright.
 
According to the lawsuit filed in Delaware, the design of the JUUL bears striking similarities to a patented nicotine delivery system created by inventor Robert Safari. Safari’s device was registered with the U.S. Patent and Trademark Office in May 2016. Swissx reportedly bought the rights to the device last year.
 
After announcing the lawsuit against JUUL, Swissx has issued cease and desist letters to several retailers, warning them to stop selling the JUUL to avoid getting caught up in the case.
 
“We don’t want innocent retailers to get swept up in this,” Rudy Delarenta, the SVP of Sales and Marketing at Swissx, said in a press release. “That’s why we’re giving them 30 days to notice to pull JUUL’s infringing products. But if they refuse, we’ll have to do what we have to do.”
 
JUUL Labs is apparently aware of the copyright infringement since 2018 and acknowledged this in a filing in 2018. Given this, it is unclear if the case will proceed or both parties will reach an agreement for an out-of-court settlement.
 
The JUUL is easily the most popular pod system on the market today. The device rose to fame in 2017 thanks to its simple, easy-to-use design. In 2018, the JUUL was valued at $2 billion, and its valuation was expected to continue to rise to about $3.4 billion in 2019. However, the projected growth has been affected by hundreds of lawsuits following allegations that the company has been marketing its products to teenagers.
 
Despite JUUL’s legal troubles, any settlement that the company reaches with Swissx is likely to be for a record amount. From a peak of around $38 billion, JUUL Labs cut its valuation twice in 2020 to $10 billion. The company has also scaled back its operations in the U.S. to cut costs. JUUL Labs has also paused its marketing and lobbying efforts in the U.S.
 
Swissx is a manufacturer of CBD products. The company, which claims to be the first mainstream CBD brand, is based in Switzerland. Swissx has a vast array of products in its collection, including smokables, oils, vape pens, chapstick, water, edibles, concentrates, isolates, and so much more. Swissx is owned by Coca-Cola heir, billionaire Alkiviades David. The company launched the Swissx Bank of Cannabis in 2019. The bank, which is the first of its kind, was launched along with a cannabis-focused cryptocurrency called SWX Coin and hemp exchange.
 
In a press released, the company explained that the “SWX Coin is backed by a bank of proprietary hemp strain seeds worth $750 and $250 million in Swiss Francs pegged to the global price of hemp.” Meanwhile, the Swissx Global Hemp Exchange will analyze and monitor software.
 
What Does This Mean for People Who Use the JUUL?
Despite the lawsuit from Swissx and the other legal troubles that JUUL Labs is facing, it is unlikely that the JUUL pod system will be taken off the shelves permanently anytime soon.
